Terms of Use – CalPoint

1. Purpose of the service

CalPoint is a platform connecting clients with beauty and wellness professionals. The service allows users to view availability and book services online. CalPoint acts exclusively as a technical intermediary and plays no part in the delivery of the final service.

2. Access and use

• Accuracy of information: The user guarantees that the data provided when creating an account or making bookings is accurate and truthful.
• Security: The user is solely responsible for the confidentiality of their login credentials and for all actions carried out under their account.
• Permitted use: The platform must be used only for personal and lawful purposes. Any misuse (fictitious bookings, interference with the system) may result in account suspension.

3. Bookings and commitments

• Binding nature: Any booking made on CalPoint constitutes a commitment by the user towards the professional.
• Cancellation: If unable to attend, the user is contractually required to cancel the appointment via their client area or to contact the establishment directly as soon as possible.
• No-show: Repeated failure to attend appointments without prior cancellation may result in restricted access to the services.

4. Liability and disclaimer

• Service delivery: The professional is solely responsible for the quality, safety, outcome and punctuality of the service provided.
• Disputes: CalPoint cannot be held liable in the event of a dispute between a client and an establishment regarding a service provided, a delay or damage suffered during the service.
• Third-party content: Information about establishments (descriptions, photos) is provided by the professionals; CalPoint does not guarantee its completeness or ongoing accuracy.

5. Intellectual property

Ownership: All elements of the site (logos, texts, structure, design) are the exclusive property of CalPoint.

Prohibitions: Any extraction, copying or reproduction of data, in particular through automated tools (scripts, bots, scraping), is strictly forbidden without prior authorisation.

6. Pilot phase (test)

CalPoint is currently in a pilot phase. Although every effort is made to ensure an optimal service, the platform may experience temporary interruptions for maintenance or updates without notice. CalPoint cannot be held liable for any technical fault preventing appointment booking.

7. Termination

The user may delete their account at any time. CalPoint reserves the right to suspend or close an account in the event of a breach of these Terms or if the user interferes with the proper operation of the platform.

8. Professional accounts and subscriptions

• Trial period: Every establishment receives a free trial upon registration, with no credit card required, giving access to all features; the number of calendars remains that of the chosen plan.
• Subscription: At the end of the trial, access to the professional console is billed according to the chosen plan (Starter, Standard, Pro or Premium) and commitment period (1, 3, 6 or 12 months, with discounts). The applicable rates are those published on the Pricing page at the time of billing.
• Billing and payment: Invoices are issued by email in the Swiss QR-bill format. In the event of non-payment after reminders, access to the console is suspended until settlement; the establishment's data is not deleted on that ground alone.
• Plan changes: The plan and commitment period can be changed at any time from the console; features apply immediately, the new rate applies from the next invoice. Downgrading requires the establishment's number of calendars to be compatible with the new plan.
• Included emails: Appointment-related emails (confirmations, notifications, changes, cancellations, reminders) are included in the price, within the real capacity of the establishment's calendar, at no extra charge.

9. Data protection

The processing of personal data is described in our Privacy Policy, in accordance with the Swiss Federal Act on Data Protection (revFADP). For end-client data entered as part of calendar management, the establishment remains the data controller; CalPoint acts as a technical processor.

10. Governing law and jurisdiction

Governing law: These Terms are governed exclusively by Swiss law (Code of Obligations).

Jurisdiction: Any dispute relating to the use of CalPoint shall be subject to the exclusive jurisdiction of the courts at CalPoint's registered office (Sion, Valais), subject to appeal to the Federal Supreme Court.
